SOS Maddie 3/05/08: the McCanns will be charged with negligence or homicide

SOS Maddie 3/05/08

The McCanns will be charged: negligence or murder.

According to a source at the Public Ministry (MP) in Lisbonne, Kate and Gerry McCann may be called to answer for the crime of negligence before a Portuguese court, it not being confirmed as yet if the couple will also be charged with murder. The Public Ministry and the PJ investigators have planned to meet officially in a few weeks time to decide what charges will be made against the couple. According to the same source, the secrecy of justice surrounding the investigation into Madeleine's disappearance is going to be maintained until August, after which, the judiciary's holidays over, the MP will be ready to progress towards the trial.

After having received the conclusive results of the forensics on traces of blood and biological and synthetic residues, the investigators saw their line of investigation confirmed, but the Public Ministry would like to be careful because in court, given the lawyers engaged by Kate and Gerry McCann, there must be no room left for the slightest doubt.

The results of the tests reveal an almost perfect similarity between the genetic profile of the blood found in the Renault Scenic rented by the McCanns and that of Madeleine. The results were identical to those carried out on the traces of blood found in the Ocean Club apartment.

Even if the traces were of good quality and the results offer no more doubt to the investigators, the procedure used for the analyses - Low Copy Number - is contested by some experts, even if the Crown Prosecution Service in the UK maintains its confidence in the process.

4 burglaries around the McCann case

According to Martin Brunt, who was sent to Portugal by Sky News, two friends that Kate and Gerry McCann left behind in Praia da Luz, the Anglican priest Haynes Hubbard and his wife, have been burgled, losing a laptop which held several documents concerned with the Madeleine case.

On the computer were the notes on which the priest was basing the preparation of the sermon for the ceremonies planned to mark the first anniversary of Madeleine's disappearance, but also all the personal emails and confidential exchanges with Kate and Gerry McCann, even after their departure for the UK. The burglar also took a mobile phone, containing all the private telephone numbers, including those of Madeleine's parents.

This burglary is not the first on people linked, directly or indirectly, to the McCann case: in a London hotel, a journalist had also had his telephone and his laptop taken. In spite of a wallet and a few thousand Euros on the night table, the burglar had preferred to take the laptop containing the only copy leaked to the media of a report by the intelligence services dealing with the Madeleine case. The article can never be finished.

Another victim of burglary, a holiday-maker of Belgian origin resident in Spain, saw his camera, containing photos taken during his holiday in Praia da Luz, disappear from his house. The burglar had not hesitated to get himself into the house during the night, when everyone was sleeping on the floor, and in spite of the presence of objects of inestimable value, the camera was the only thing taken.

More recently, the residence neighbouring inspector Gonçalo Amaral's apartment was the target of burglars. According to a local police source, the burglar got the wrong house, in the end taking away only some documents.

************************************
So, to sum up the haul from the burglaries:

  • Laptop and mobile phone belonging to the priest, containing private phone numbers and confidential communications with Kate and Gerry McCann
  • Laptop belonging to a journalist, which held the only copy of a report by the intelligence service about the McCann case, leaked to the media.
  • A holiday-maker's camera containing photos of his holiday in Praia da Luz.
  • A few documents from the home of inspector Gonçalo Amaral's neighbour.

Seems that those people are very unlucky, victims of strange coincidences, or maybe we could decide that too many items, linked directly or indirectly to the Madeleine case, seem to be going missing.

Enfants Kidnappés - Josef Fritzl - whole nights in the cellar

Yesterday morning, on my way to work, I was listening to, "Thought For The Day." The presenter spoke about a Biblical reference to, "The mystery of evil," and of how some people can be so consumed by evil that they become, "a parody of a human being." While Michel Fourniret is on trial for seven abductions and murders of young women and girls, the news about Josef Fritzl and his evil treatment of his daughter and the seven children bursts into the world's media. Two very evil men, parodies of all that is human.

Josef Fritzl's sister-in-law has revealed to the investigators that he went down to the cellar every morning, often at night to, "develop designs for machines." The shock happened, tongues were loosened. That of the accused, was first: in the course of his interrogation, Josef Fritzl, the Austrian father who imprisoned and raped his daughter for 24 years in a windowless cellar, where seven children were born of the incest, acknowledged that he had threatened to poison his victims with gas if anything should happen to him.

Today, six police experts carried out, "inspections," in the 60m2 underground nuclear fall-out shelter, to find out if such a device actually existed, or if his threats had no other purpose than to keep his hold over his victims. Josef Fritzl's sister-in-law also revealed that this man often spent, "the whole night," in the cellar of his house in Amstetten.
"Every morning he went down into the cellar at seven o'clock, telling us that he was going there to develop designs for machines which he was selling to businesses." the younger sister of Josef Fritzl's wife, Rosemarie, adds in the daily newspaper, Österreich. "Rosi did not even have the right to take him a coffee," she continues.

Sentenced for rape in 1960. In this interview, the sister-in-law confirms Josef Fritzl's prison sentence for rape, at the end of the 1960s, now erased from police records. "I was 16 years old when he was imprisoned and I found this offence repugnant, especially as he already had four children with my sister," she said in her witness statement. The police think that Rosemarie, a woman described by her sister as, "dominated and constantly put down in public," by a despotic husband, was unaware of his activities in the cellar.

But this point still raises questions for the Austrian press, the serious daily Kurier running a headline, "What did the wife know?" On Wednesday afternoon, the police carried out checks on an unexplained murder in 1986 in Haute-Autriche near a restaurant belonging to Josef Fritzl, a police officer stated. "There is no direct link, but the suspect was present at that time in the region." the Haute-Autriche director of public security stated to AFP. The young 17 year-old girl was found dead, the victim of sexual abuse, on the shores of the Mondsee lake, not far from the boarding house, which was owned by and lived in at that time by the Fritzl family. The heavy door of reinforced concrete also poses many questions for the investigators. Controlled electronically, it blocked access to the nuclear fall-out shelter in which Elisabeth was held with three of her seven children. "We have requested an expert opinion on this imposing door and on the closure mechanism." stated Franz Polzer, the chief officer of the Basse-Autriche criminal investigation police.

There were no suspicions.

The head of social services, Heinz Lenze, came to the defence of his team on Tuesday, saying that they had proceeded with all the checks which they thought were necessary. "There were no suspicions about the actual presence of the mother in the cellar of that house," he stated and so, no reason to proceed to a search which perhaps would have allowed the case to be revealed much sooner.
Since the first adoption in 1994, the social workers have visited the Fritzls 21 times to make sure that the children were well.

The detention of Elisabeth and her three children would perhaps have been able to be cut short if the team which came in 1999 to fix the boiler, situated in a room adjacent to the shelter where the victims were held, could have imagined what was going on behind the wall.
"They had no opportunity to learn what was hidden behind it," stressed a spokesperson for the municipal services, Hermann Gruber, questioned by the television channel ORF.
Questioned on Tuesday about the snaps published in the press showing the suspect on holiday in Thailand in the 1990s, the chief of Criminal Police in Basse-Autriche, Franz Polzer, stated that this track did not necessarily implicate the complicity of a third party to feed the captives in his absence. The bunker had enough space for stocking food for several weeks, according to him.
Meanwhile, on Tuesday, the police searched five more of Josef Fritzl's properties, searching for identical shelters, but without success.

Fear and misunderstanding.

On Tuesday evening, hundreds of shocked Amstetten residents, held a candle lit vigil as a sign of hope after the drama. A border of candles was formed in the main square of the town of 23,000 inhabitants, situated a hundred kilometres from Vienna.
The austrian press continues to ask questions. "A confession and 1,ooo questions," was headlined on Tuesday by the daily Kurier, suggesting that the, "double life of Josef Fritzl was still hiding many secrets."
For the daily, Der Standard, "it is particularly shocking and revolting to know that the neighbours knew nothing, saw nothing, while explaining before the cameras that they had had the impression that something strange was going on."
The Austrian Chancellor, Alfred Gusenbauer, has however, promised to prvent the image of his country becoming tarnished by this sordid story, two years after the Natascha Kampusch case. "There is no Amstetten case, there is no Austrian case, there is only a particular case," he stressed on leaving the council of ministers.

Six months of investigation.

In spite of Josef Fritzl's confessions, Franz Polzer estimated on Monday that the investigation could last more than, "six months." The time to examine the evidence which the investigators are bringing out in full boxes, from the house where the man imprisoned his daughter Elisabeth, aged 42, for 24 years, with three of the seven children born of the incestuous relationship, which he imposed on her.
It is also necessary to wait for the victims, sheltered together from the media in the psychiatric unit of a clinic in Amstetten-Maurer, to find sufficient psychological balance to be able to cope with a hearing.
Elisabeth, five of her children and her mother Rosemarie, are each on an individual course of therapy, even if they are together in the same care unit, because they are, "all traumatised to different degrees," the head of the clinic, Berthold Kepplinger, stressed on Wednesday.

Schizophrenia or narcissism.

The suspect has been isolated from the other detainees for his won protection in the police holding cells where he has been locked up. "We guarantee him a very strong protection to guarantee the smooth course of the judicial process," stated the director of the establishment. "These people are at the bottom of the hierarchy of detainees and are particularly threatened," he stressed.
Remaining silent during his first hearing by the magistrate on Tuesday, he should adopt the same attitude on the advice of his lawyer, Rudolf Mayer, a specialist in high-profile media cases. First of all his defence lawyer calls for a psychiatric evaluation, "It is necessary to determine if my client is responsible for his actions. Perhaps he is schizophrenic, he had, anyway, a double life," he pondered in the daily, "Die Presse.
"
